Chapter 1 General Provisions
Article 1 (Purpose)
The purpose of this agreement is to define the rights, obligations, and responsibilities of the "Site" and users when utilizing the internet-related services (hereinafter referred to as "Services") provided by the Seil Music Culture Foundation (hereinafter referred to as "Company") operating KoreanArtSong.com (hereinafter referred to as "Site").
Article 2 (Definitions)
1) "Site" refers to the music-related homepage constructed by the Company that utilizes computer and telecommunications equipment to provide internet (related) services to users.
2) "User" refers to individuals who access the "Site" and receive services provided by the "Site" in accordance with this agreement, including both members and non-members.
3) "Member" refers to individuals who have provided personal information to register as a member of the "Site," thereby allowing them to continuously receive information from the "Site" and utilize the services provided by the "Site."
4) "Non-member" refers to individuals who use the services provided by the "Site" without registering as a member.
5) Definitions of terms not specified above are determined by relevant laws and regulations as well as stipulations set by the Company.
Article 3 (Disclosure and Amendment of Terms)
1) The "Site" may amend these terms within the bounds of relevant laws, including the Act on the Regulation of Terms and Conditions, the Basic Electronic Commerce Law, the Electronic Signatures Act, the Act on Promotion of Information and Communications Network Utilization, the Door-to-Door Sales Act, and the Consumer Protection Act.
2) When the "Site" amends the terms, it will specify the effective date and reasons for the changes in advance, notifying users on the main page of the "Site" at least 7 days prior to the effective date.
3) Amended terms will only apply to contracts formed after the effective date and will not affect agreements made prior to that date unless the user has communicated their consent to the amended terms during the notification period.
4) For matters not specified in these terms and for their interpretation, relevant laws and customary practices established by the government shall apply.
Chapter 2 Service Utilization Agreement
Article 4 (Interruption of Services)
1) The "Site" may temporarily suspend the service due to reasons such as maintenance of computer or telecommunications equipment, replacement, malfunction, or communication disruptions.
2) In cases of service suspension, the "Site" will notify users in accordance with Article 8. However, if the service interruption is due to reasons beyond the "Site's" control (such as disk failures not caused by the administrator's intent or negligence, system outages, etc.), prior notification may not be possible.
Article 5 (Membership Registration)
Users can apply for membership by filling out the required information on the registration form set by the "Site" and expressing their intention to agree to these terms. The "Site" will grant membership only if the applicant does not fall into any of the following categories:
1) If the applicant has previously lost their membership status and 3 years have not passed since the loss, unless they have received approval for rejoining from the "Site."
2) If there is false information, omissions, or errors in the registration details.
3) If the "Site" determines that registering becomes technically difficult.
4) The contract for membership shall be considered established when the "Site's" acceptance reaches the member.
5) Members are obligated to inform the "Site" immediately of any changes to their registration details via email or other means.
Article 6 (Membership Withdrawal and Loss of Qualification)
Members can request withdrawal from the "Site" at any time via email or through the membership information modification link, and the "Site" will process the withdrawal immediately.
The "Site" can restrict or suspend membership under the following circumstances:
1) If false information was registered during the application process.
2) If the member threatens the operational order of the "Site" by obstructing others from utilizing it or by misappropriating their information.
3) If the member engages in acts prohibited by laws or by these terms while using the "Site."
4) If the same conduct occurs more than twice after restriction or suspension of membership status by the "Site," or if the cause of such conduct is not resolved within 30 days.
5) If the member unlawfully uses someone else's ID and password.
6) If the member disseminated a computer virus within the "Site."
7) If the member infringes on the intellectual property rights of the "Site," other members, or third parties and refuses to rectify the issue.
8) If the member loses their qualifications, their registration will be annulled. In such cases, the "Site" will notify the member and provide an opportunity for them to explain before annulling the registration.
Article 7 (Notification to Members)
When the "Site" provides notification to members, it may do so via the email address submitted by the member.
For notifications to unspecified large numbers of members, the "Site" may substitute individual notifications by posting a notice on the "Site" bulletin board for over one week.
Chapter 3 Service Provision and Use
Article 8 (Establishment of Service Usage Agreement)
1) By clicking the "Agree" button to the question "Do you agree to the membership terms?" on the membership registration page, users are recognized as agreeing to the terms.
2) A contract is considered established when the acceptance of the "Site" is received by the user in the form of a confirmation notice as defined in Article 15.
Article 9 (Service Usage Time)
1) Unless there are special operational or technical reasons, services provided by the "Site" can be accessed continuously.
2) The services may not be available during scheduled regular maintenance or temporary maintenance periods as determined by the company.
3) Depending on the type of service, there may be instances where continuous provision is not possible, as determined by the "Site."
Article 10 (Interruption of Services)
1) If the "Site" must temporarily suspend services due to specific difficulties, it will notify users at least 2 days in advance. The "Site" is not responsible if users fail to recognize the notification during this period.
2) In cases of urgent circumstances, the advance notice period may be shortened or waived. The "Site" is also not responsible for maintaining or transmitting messages and other communication data stored or sent on the "Site" that may be lost or deleted due to service suspension, including any failure to transmit such data.
3) If the "Site" must permanently discontinue services for its reasons, paragraphs 1 and 2 apply. However, in this case, the advance notification period must be at least 1 month.
Chapter 4 Rights and Obligations Related to Services
Article 11 (Personal Information Protection)
1) The "Site" collects only the minimum necessary information required to provide services during user registration. The following information is required, while any additional information is optional:
(1) User ID
(2) Password
(3) Security question for lost password
(4) Answer for lost password
(5) Name
(6) Nickname
(7) Email
(8) Phone Number
(9) Mobile Number
(10) Postal Code
(11) Address
2) The "Site" must obtain the user's consent when collecting personal information that can identify them. Provided personal information cannot be used for purposes other than those consented to or provided to third parties without the user's consent, and the "Site" is responsible for this. (However, information may be shared only for sites operated directly by the Company, e.g., disong.co.kr.)
3) When the "Site" needs to obtain user consent, it must clearly identify the personal information management officer (affiliation, name, phone number, and other contact details), the purpose of data collection and use, and details related to information provision to third parties (who will receive the information, purpose of provision, and the specific content of information). This must comply with Article 16, Paragraph 3 of the Act on Promotion of Information and Communications Network Utilization, and the user can withdraw consent at any time.
4) Users may request to view and correct their personal information held by the "Site" at any time, and the "Site" is obligated to take necessary actions without delay. If the user requests correction of errors, the "Site" will not use the respective personal information until the error is corrected.
5) To protect personal information, the "Site" limits the number of administrators to the minimum necessary and is responsible for any damages incurred by users due to loss, theft, leakage, or alteration of personal information.
6) The "Site" or any third-party that received personal information from the "Site" will destroy such information without delay once the purpose for which it was collected or provided has been fulfilled.
Article 12 (Obligations of the "Site")
1) The "Site" shall not engage in any activities prohibited by laws and regulations or contrary to public order and morals, and shall make every effort to provide services continuously and reliably as stipulated in these terms.
2) The "Site" must implement a security system to protect user personal information (including credit information) so that users can safely utilize internet services.
3) The "Site" will not send unsolicited commercial electronic mail advertisements unless the user has expressed a desire to receive them.
Article 13 (Obligations Regarding User ID and Password)
1) The member is responsible for managing their User ID and password.
2) Members must not allow their User ID or password to be used by third parties.
3) If a member becomes aware that their ID or password has been stolen or is being used by a third party, they must notify the "Site" immediately and follow any instructions provided by the "Site."
4) User IDs must be issued in the real name as registered in the national identification system.
5) User IDs cannot be shared or transferred. If a member shares or transfers their ID without prior consultation with the Company, the Company can suspend the respective ID. However, this does not apply if otherwise agreed upon in a separate contract between the Company and the member.
Article 14 (Obligations of Users)
Users must not engage in any of the following acts. If any of the following acts are discovered, the Company may suspend or revoke the user's membership:
1) Registering false information during application or modification.
2) Changing information posted on the "Site."
3) Sending or posting information (such as computer programs) other than what is specified by the "Site."
4) Infringing on copyright or other intellectual property rights of the "Site" or other third parties.
5) Damaging the reputation of or interfering with the operations of the "Site" or other third parties.
6) Publicly disclosing or posting obscene or violent messages, images, audio, or any information that goes against public order and morals on the "Site."
7) Using another member's ID.
8) Unauthorized use or dissemination of information obtained through services provided by the "Site" without the Company’s approval.
9) Harassing other users, including acts of stalking.
10) Sending or posting unauthorized advertisements or promotional materials (including junk mail, spam, chain letters, pyramid schemes, etc.) via email or other means without the "Site's" approval.
11) Collecting or storing another user's personal information.
12) Engaging in any acts that violate relevant laws and regulations.
Article 15 (Information Provision and Advertising by the "Site")
1) The "Site" may periodically or irregularly send out mailing/text marketing services that members have expressed a desire to receive upon registration. However, if a member indicates a refusal, this will be immediately discontinued.
- New music and IPA uploads.
2) The "Site" may display advertisements for services offered on the "Site."
Article 16 (User Posts)
The "Site" may delete content posted by users without prior notice in the following cases:
1) When abusive remarks or vulgar expressions are used against others.
2) Exceeding the posting period set by the "Site."
3) Posting obscene materials or links related to obscene sites.
4) Posting content that infringes on the copyright of the "Site" or others.
5) Violating public order and morals or relevant laws.
Article 17 (Copyright Attribution and Usage Restrictions)
1) The copyright and other intellectual property rights for works created by the "Site" are owned by the "Site." Users must not reproduce, transmit, publish, distribute, broadcast, or use the information obtained through the "Site" for commercial purposes nor allow third parties to use it without prior consent from the "Site."
2) Rights and responsibilities regarding posts (such as text, videos, audio, etc. registered by users on the "Site") lie with the poster. The "Site" does not use posts for commercial purposes without the poster's consent.
Article 18 (Dispute Resolution)
1) The "Site" actively addresses any legitimate opinions or complaints raised by users and processes related damages.
2) Complaints and opinions submitted by users are prioritized for resolution by the "Site." However, if a swift resolution is difficult, the user will be immediately informed of the reason and the processing schedule.
Article 19 (Disclaimer)
1) The "Site" is exempt from responsibility for service interruption due to natural disasters or force majeure, as well as for loss or damage to data uploaded by users.
2) The "Site" is exempt from responsibility regarding the truthfulness or accuracy of information posted by users.
3) The "Site" is exempt from responsibility for damages incurred by users that are due to the user’s intent or negligence in connection with service usage.
4) The "Site" is not responsible for the loss of anticipated profits by members using the service and is exempt from responsibility for any damages resulting from materials obtained through the service.
Article 20 (Refund Policy)
1) Due to the nature of digital content, refunds are not available for any reason after payment has been made. (However, if the purchased goods are damaged or if there is a significant discrepancy between what was purchased and what is described on the "Site," a refund will be issued upon verification.)
2) If the content has not been downloaded after payment, a refund request can be made within 3 days, and the payment can be canceled without any fees.
These terms and conditions take effect on February 1, 2025.
